The following terms apply specifically to our SMS messaging program. By opting in to receive text messages from Elevar Media Group, you agree to these terms:

2.1 Opt-In and Consent

• You must be at least 18 years of age and the owner of the mobile number you provide, or have the owner's authorization, to opt in to our SMS program.

2.2 Message Types and Frequency

• Reply HELP to any message to receive support contact information.

• Upon opting out, you will receive one final confirmation message. No further messages will be sent unless you re-opt in.

2.4 Carrier Compliance

• Our SMS campaigns are registered with The Campaign Registry (TCR) and comply with 10DLC carrier requirements, including those of AT&T, T-Mobile, and Verizon.
• We reserve the right to modify message content, frequency, and campaign scope as required by carrier regulations.
• We are not liable for delayed or undelivered messages resulting from carrier network issues, filtering, or technical limitations.

2.5 Number Portability and Changes

• If you change or port your mobile number, you must re-opt in to continue receiving messages.
• We are not responsible for messages sent to a number that has been reassigned to a different user after you opted in.
• Recycled numbers are removed from our active subscriber list per carrier requirements.

3. Use of Our Website and Services

You agree to use our website and services only for lawful purposes. You must not:

• Use our services to send unsolicited messages, spam, or fraudulent communications.
• Attempt to gain unauthorized access to our systems, networks, or data.
• Interfere with or disrupt the operation of our website or services.

Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that our SMS messages will be delivered on time, without error, or uninterrupted. We do not warrant that our website will be secure, error-free, or available at all times. Your use of our services is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Elevar Media Group and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our website or services, including our SMS messaging program. Our total liability for any claim shall not exceed the amount you paid us, if any, in the six (6) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Elevar Media Group, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

9. Privacy

For material changes to SMS program terms, we will notify active subscribers via SMS and obtain new consent where required by law or carrier regulations. 11. Termination
